However, Lady Justice Rose upheld the original ruling in the case, cracking down on the design of the Universal Credit system.

She said: “This case is, in my judgement, one of the rare instances where the Secretary of State for Work and Pensions’ refusal to put in place a solution to this very specific problem is so irrational that I have concluded that the threshold is met because no reasonable minister would have struck the balance in that way.”

The judges at the Court of Appeal stated the failure to take into account bank holidays and weekends affecting payment was unlawful, and needed change. 

The DWP have now conceded the case, and will work on a solution to the issue.
